BREAKING: Trump Administration Revokes Guidance on Transgender Student Protections

After several days of speculation, President Donald Trump has rescinded an Obama administration letter advising schools to allow transgender students to use restrooms that match their gender identity.

Here’s what you need to know

  • President Obama issued guidance to schools across the country in May 2016 directing them to allow transgender students to use restrooms that match their gender identity, or otherwise provide facilities they can use. 
  • A federal judge suspended the order in August after a group of states, led by Texas, sued the federal government.
  • With the guidance rescinded, schools will face no pressure from the White House to accommodate transgender students' bathroom preference. 
  • Still, despite the White House’s stance, LGBT activists believe that 1972 Education Amendments on Title IX, which prohibits sex-based discrimination in schools, still protect the right of transgender students to use the bathroom of their choice.
